Jury Nullification…

   I recall my counsel telling me back in ’89, when I was facing a drug conspiracy charge, that my only actual hope at trial would be “jury nullification.” Of course, the reality is that the courts forbid informing the jury of their power to decide the law for themselves.

Courts, Corporatists & Other Criminals…

While the corporate media distracts the public with their trick-bag of dysfunctional Republican idiots, aka candidates, the US Supreme Court pulled off another three-card monte.

In a devilish compromise, the Court unanimously instructed a lower court in Texas to “take another look” at the Texas Legislator’s redistricting maps (favoring Republicans).

The Texas court had redrawn the Congressional voting maps in line with the Census count (as required by the Constitution).

That remapping included fair representation by the affected Hispanic communities. The USSC effectively killed that plan. more…

The latest issue of the Prison legal News (July 2011) headlines a front-page article on the US Supreme Court’s recent 5-to-4 decision calling for relief of California’s “cruel and unusual” prison system.

Crack Cocaine Retroactivity…

Dateline: Wash DC, 30Jun2011: For the second time in 16 years, the US Sentencing Commission is trying to apply a reduction in disparity between crack and powder cocaine sentencing.  Today, the Commission voted unanimously on a decision to apply the pending crack law retroactively!

Colombian sub: Opps! Where’d the coke go??

Unless Congress intervenes in that decision from becoming law on November 1st, FAMMreports that some 12,040 inmates will be estimated to be eligible for early release from federal prison. Their average age is 36.  Over 85% are black.

Those sentenced with aggravating and mitigating circumstances will not be eligible.  But, this site cautions: We’ve been there before… more…

Clarence Thomas—The Last Overseer…

I chose to serve a 25-yr sentence in federal prison rather than betray others.  At some point in my youth and experiences I acquired a social consciousness, and a special animus for those who would sell their souls at any price

Having spent most of my lifetime in human rights and political struggle, and having served Honorably from 1959-to-1965 in the American Civil War in the Jim Crow South–precisely a century after the first one–it truly pains me to witness some turn traitor on their own people, their race, their class, their very family history.

While I’m a non-theist and don’t believe in fairies, ghosts, goblins or gods, I do believe in a universal connection tying all things to all times.  I believe we all come from the same source—star stuff, if you will—to which we all return.  It’s not a personal thing.

   I don’t submit any answer to the Great Mysteryof where all this originally came from…nor do I believe can anyone else.  Life is one aspect of universal existence.  Individual consciousness is one of the most fleeting and perhaps the greatest of illusions.  But nevertheless, this is where we live. more…

Lest some of my readers think that my comments were far-fetched, the following day, in echo of the sentiments we expressed, Attorney Bruce Fein, a former Associate Deputy Attorney General for Ronald Reagan, had a letter published in the NY Times (11Feb2011) stating:

   “Justice Antonin Scalia galloped far beyond the furthest boundaries of judicial propriety in secretly meeting on Capitol Hill to discuss the Constitution with Tea Party members of Congress saddled with a co-equal duty to assess the constitutionality of legislative action.  If there are better ways to destroy public confidence in judicial impartiality, they do not readily come to mind.

   “…Justice Abe Fortas was forced to resign for, among other things, secretly advising President Lyndon B. Johnson on race, urban unrest and the Vietnam War.”  more…

Corporate Court...

Hans Post, was in the famed unit of Col. Otto Skorzeny’s Waffen SS Kommando.  He served (two Iron Crosses) at the Battle of the Bulge (in American uniform), the Russian Front, was captured and escaped from the Czech partisans, was a POW at the infamous killing camp of the French at Thoree les Pins, and did a stint in a German post-war prison for selling a contraband pistol. more…
